CONSUMER DISCRIMINATION
Racism is alive and well. Unfortunately, the current political environment has fueled intolerance, ignorance and racism throughout our communities and the nation. Although racism still permeates our society, it is different. Seldomly do we see overt and direct racism like we saw during the Civil Rights movement, such as vocalizing racial epithets’ and acting upon racist ideology.
Today we see a more subtle racism, which on its face you can’t see it. However, upon taking a deeper look, you can discover a racist environment or actions. We prominently see racism playout in the workplace. What is less known, yet still prevalent, is racial discrimination against a customer and/or consumer in the marketplace. This is known as consumer discrimination.
We see consumer discrimination when employees of a business or corporation discriminate against a customer/consumer because of their race, skin color or national origin. The employees act in discriminatory manner by refusing to offer a service or they provide a service in a hostile manner.
Here are two (2) examples of situations that we see the manifestation of consumer discrimination:
- A customergoes to a service business for example a restaurant, auto shop or supermarketand they are refused or denied service for unknown or pretextual reasons despite the business offering the same service to people who are white.
- A customer enters into a “consumer contract”, for example buying an airline ticket, but the conduct in which the airline, business or corporation provides the service is different and racially motivated because other similarly situated people are receiving a better service.

(a)Statement of equal rights
All persons within the jurisdiction of the United States shall have the same right in every State and Territory to make and enforce contracts, to sue, be parties, give evidence, and to the full and equal benefit of all laws and proceedings for the security of persons and property as is enjoyed by white citizens, and shall be subject to like punishment, pains, penalties, taxes, licenses, and exactions of every kind, and to no other.
(b)“Make and enforce contracts” defined
For purposes of this section, the term “make and enforce contracts” includes the making, performance, modification, and termination of contracts, and the enjoyment of all benefits, privileges, terms, and conditions of the contractual relationship.
(c)Protection against impairment
The rights protected by this section are protected against impairment by nongovernmental discrimination and impairment under color of State law.
